After a collision in Ontario, there are usually two claims — not one.

The things people ask before they call

What does it cost to talk to you?

Nothing. The consultation is free and there's no obligation to hire us afterward. If we don't think you have a claim, we'll say so — you'll still leave the conversation knowing more than you did going in.

What if the accident was my fault?

You may still be entitled to compensation even if you caused or contributed to the accident. Ontario's accident-benefits system provides access to certain benefits regardless of fault, and depending on the circumstances you may have additional claims on top of that. A lot of people assume being at fault ends the conversation — it often doesn't, and people in that position do reach settlements. We can determine what compensation and benefits may be available to you and handle the process on your behalf.

What if I was partly at fault?

You may still have a claim. Ontario law allows for shared fault, and a finding that you were partly responsible generally reduces what you recover rather than eliminating it. Fault is also frequently assessed wrong at the scene. It's worth having someone look before you assume the answer.

I already gave the insurance company a statement. Is it too late?

Usually not. Adjusters call early for a reason, and people often say things that don't reflect how badly they were hurt — because they don't know yet. Call us and we'll go through what was said and where it leaves you.

Will I have to go to court?

Most personal injury claims in Ontario settle without a trial. That said, cases tend to settle properly when the other side believes you're prepared to go the distance, so we build every file as though it may be tried. Less than 1% of cases go to trial, and it will always be your decision whether or not to take your case to trial or settle before.

How long does a claim take?

It depends on your injuries and how your recovery goes. Part of valuing a claim is knowing where you'll end up medically, which takes as long as it takes. Straightforward claims can resolve in months; serious injuries often take longer. Every case is different — you will have a much better idea of the timeline after reviewing your case with the lawyer.

How do legal fees work on an injury claim?

We only get paid when you get paid. There are no up-front fees, and any legal fees come from the settlement that we recover for you from the insurer. Disbursements and HST may still apply, and the specifics are set out in a written retainer agreement. We'll walk you through exactly how it would work for your case during your free consultation — before you commit to anything.
